Our use and transfer of any information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

Indemnity and Release

You agree to release, indemnify and hold BeVisibleHQ, its officers, employees, directors, and agents harmless from any and all losses, damages, expenses, including reasonable attorneys' fees, rights, claims, actions of any kind and injury (including death) arising out of or relating to your use of the Site and/or Services, any User Content, your connection to the Service, your violation of these Terms or your violation of any rights of another.

1. Introduction

1.1. These Terms of Service ("Terms") govern your use of BeVisibleHQ ("our", "we", "us") services and products ("Services"). By using our Services, you ("User", "you", "your") agree to be bound by these Terms.

2. Scope and Service

2.1. BeVisibleHQ provides AI-assisted business visibility and marketing tools, including SEO, AEO and GEO analysis, competitor research, website and content creation, advertising creative, social publishing, and related analytics and automation features. Some features may depend on third-party integrations, plan eligibility, or customer-provided credentials. Payments and subscriptions are processed by our payment provider.

2.2. Generated ad creative is saved to your account library for you to review. Turning on auto-advertise for a platform schedules and generates creative for that platform; it does not publish or post on your behalf unless you have explicitly connected that platform account and enabled publishing for it.

3. User Obligations

3.1. When using our Services, you agree not to upload, publish, or request generation of content that is illegal, harmful, abusive, explicit, violates copyright or trademark law, or otherwise infringes upon the rights of others.

3.2. You are solely responsible for the business information, product details, and content you submit for generation. We do not pre-screen User content and are not liable for content generated or shared through our Services.

3.3. If we receive notice of content violating these Terms, we retain the right to remove it and may terminate your access to our Services.

3.4. Eligibility. You must be at least 18 years old and able to form a binding contract in your jurisdiction to create an account or use our Services. If you are using our Services on behalf of a company or other entity, you represent that you are authorized to bind that entity to these Terms. We may terminate any account we believe belongs to a person under 18.

4. Domain Registration Fees

4.1. When you purchase a domain through BeVisibleHQ, the total price shown before you confirm the purchase is the registrar's own registration cost plus a flat $3 service fee charged by BeVisibleHQ for handling the purchase, DNS setup, and renewal management on your behalf. This fee applies to the initial purchase and each annual renewal and is already included in the total shown -- it is not added afterward.

4.2. Domains are purchased with auto-renew handled by us rather than the registrar: each year, we charge your payment method on file for that year's renewal price (again including the $3 fee). If that charge cannot be completed, the domain is left to expire rather than renewed at our expense.

5. Intellectual Property Rights

5.1. By using our Services, you ensure you have all necessary rights and authorizations for any content, trademarks, or business information you submit and for the subsequent use of that content.

5.2. You retain ownership of any intellectual property rights to the content you provide.

5.3. By submitting content for generation, you grant us the non-exclusive right to use, copy, and display that content for the purpose of providing and improving our Services on your behalf (for example, rendering website content, reports, or ad creative).

6. Prohibition Against Copying

6.1. You agree not to copy, reproduce, distribute, or create derivative works of any aspect of our Services, including our functionality, user interface, site design, elements, logo, or overall business model.

6.2. Unauthorized use or reproduction of any part of our Services will be considered a violation of these Terms and may result in legal action, including termination of your account and pursuit of legal remedies.

7. Disclaimer and Limitation of Liability

7.1. Our Services are provided "as is" and we expressly disclaim any warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2. Under no circumstances shall we be liable for any direct, indirect, incidental, special, consequential, or exemplary damages due to your use or inability to use our Services. We do not guarantee any particular business outcome, traffic, sales, or ad performance from using our Services.

8. Termination

8.1. We reserve the right to terminate your access to our Services, without prior notice, for any reason at any time.

8.2. We reserve the right to delete any inactive project, site, or related data after a 3 month period of inactivity on our platform.

9. Cancellation & Refund Policy

9.1. You may cancel your subscription at any time. There is no binding contract. Cancellation takes effect at the end of your current billing period -- you retain full access until then and will not be charged again. We do not charge cancellation fees.

9.2. You may cancel from the Pricing & Billing page using the billing portal link, which takes you to our payment processor's self-serve portal to manage or cancel your subscription directly.

9.3. Monthly plans: we do not offer refunds for partial months of service. If you cancel mid-cycle, your plan remains active until the billing period ends.

9.4. Technical issues: refunds may be issued at our discretion in cases of a documented technical failure on our part that prevented access to the Service. To request a discretionary refund, contact us within 30 days of the charge.

9.5. Domain purchases are final once the registration is completed with the registrar, except where a purchase fails outright, in which case any charge is refunded in full.

10. Expectations

10.1. We are not responsible for the performance of your website, marketing campaigns, your financial expectations, or how your content is ranked or distributed by any third-party platform or search engine.

10.2. We do not guarantee that you will make money, generate traffic, improve rankings, or achieve any particular business outcome by using BeVisibleHQ. Our tools provide research, recommendations, and workflows intended to support your own marketing and business activities.

11. Changes to Terms

11.1. We reserve the right to modify these Terms at any time. It is your responsibility to review the Terms regularly. Your continued use of our Services constitutes acceptance of any modifications.

12. Governing Law and Jurisdiction

12.1. These Terms will be governed by and construed in accordance with the laws of the State of New Jersey, without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the state and federal courts located in New Jersey for the resolution of any disputes.
